Ok thank you, the man who imaged it and arranged the appointment at the JC didn't say this, he said it was noted on my file and shouldn't be a problem and that that date was the earliest available date, which was a day later than the 'returned by' date given on my form, so that wasn't in my control. I guess I can include all this information when I speak to them and write for a MR, assuming a MR is needed.

Sorry if I am repeating myself, ring the DWP today and get an address to send your ESA50 to.

There is a small window of time for you to get your claim restarted in, if you go to MR then you have already lost the battle.

Just a little update although I'm still not sure what's happening but I rang DWP today and they said that my file now says the claim should never have been closed and a payment has been authorised. I asked what happens now and they said that I'm being paid and a letter will come out to me, apparantly all letters are sent on a Friday so either it hadn't arrived yet or its being sent Friday. I asked how much payment and the amount didn't fit anything but seems to be for a random amount of time of around three weeks and is approximately £375 but doesn't run from when my last claim ended?
So I don't know if a decision has been made or if I'm being paid whilst they assess me?!
I may ring again and see if someone can explain it a bit more. :blink:

My guess and it is no more than that at the moment, is that the ESA50 turned up, the procedure where this happens is for the claim to be continued.

I'd be interested if the DWP supply more information.

I have spoken to them again and this person was a lot more helpful. It seems my reason for it arriving late was seen as acceptable so
I am now being assessed and payment has resumed however the payment date from
when it's been resumed is several days after my claim was due to restart so they have now put a query through to payments to look at what and why and payments are meant to be calling me to explain or correct.
Now the wait to see if I have to have a f to f too. I cannot self propel a wheelchair when I use one and I am in chronic and acute pain all the time I weightbare or walk from standing onwards so I am hoping I will be continued in the support group
as before ... which I stated ... we'll see.
I have also chased my pip and motability payments as my benefit was taken long before my car arrived so now that's being paid back to me too.
