CAB don't know and Solicitors won't tell me unless I pay £500, so can I ask on here please -
I have inherited my father's estate - left solely to me to make sure my sister-in-law does not get any. However, I am on ESA. When I receive the cash element (I am living in the property already and will be staying here) I want to give it to my brother seeing as I am in the house - only fair.

Am I allowed to gift the cash to him, as I am claiming ESA? The cash will take me to £7000, so over the allowed £6000.

With capital over £6000 will DWP be forever watching how I spend it?

I'm sorry but we can't give detailed financial advice on the forum, although I can say not to waste your time with a solicitor unless they can show previous experience of dealing with benefit claims/

The issue is one of Deprivation of Capital and it is likely that only a DWP Decision Maker can give you an answer, however, you can try and find advice by doing an internet search for "welfare advice" with your postcode, town or county.
