If someone has lost pip but previously had high rate DLA and are appealing but want to work and have severe epilepsy but are on high medication what happens if they get a job

PIP is not an out of work benefit, claimants work and receive the highest rates of PIP while doing so, however, the limitations that made the award possible must not be at odds with the work that they are doing.

As you do not appear to have an award at the moment then you are under no obligation to contact the DWP and your working is not relevant to your appeal, however, if an award is made then you need to consider contacting the DWP about the work you are doing, failing to do so may not be to your advantage if concerns over you award are made by the DWP.

I asked this question the other day so sorry for repeating not sure if I put in the correct place, do any members work and have had a pip appeal, my son lost all his points and has recently got a temporary job but still has his seizures because he's trying to work will that go against him at his appeal

Hi Mary,

I have merged your query with the previous one relating to your son's PIP. You will find your previous messages if you click in your username, in blue, when you are logged into the forum.

If working is contrary to the limitations your son has described on his PIP claim, he might have to explain how he is able to manage working. If the answer is that he is not managing then he should make that clear to the Tribunal panel.

Hello at the time of filling out his form I stated that he was looking for work as he hoped that despite having severe epilepsy he hoped to work at some time he has since got a temporary job but has had a seizure while working.
We don't know how long the work is for as a number of employees have been finished today.
I'm worried that this will go against his appeal even though we have support from Gp and MP and I know it says it's not a means tested benefit.
My son went to special school then college and last year got a degree with support for his dyslexia too this is his first job at age 27 but because he's worked so hard and achieved so much they gave him zero points but he still has the condition

The Tribunal panel cannot take into account any change in your son's circumstances since the Decision being appealed was made, however, the fact that you said he was looking for work may open the door for them to question him about this.
