I posted three weeks ago asking about retaining Long term Incapacity Benefit at retirement age 60 for women, and was told as far as anybody knew it stopped when you got your pension. Since then I have found that on page 15 of the State \pension Information booklet(BR33 10/08) that i received with my pension forecast. That it states that, "If you are sick or disabled" section, that you will usually stop getting IB when you reach State Pension Age. But sometimes you can keep getting it. Hi,

I'm not aware of this. I was 60 years old on 29 July 2009, and despite being on IB long term and paying full N.I. contributions during my career as a nurse, I was told that my IB would cease on 28 July 2009, and that I couldn't stay on IB but would receive full State Pension (SP)

I could have opted to defer my pension and would be paid more SP if I did but if I'd done that I couldn't stay on IB, nor could I receive any means-tested benefits as I receive an NHS occupational pension as well as SP.

I can only advise you to ring the number you've been given, and ask who can continue to claim IB after reaching SP age.

I'd be interested in what they tell you, because I was told by both JobCentre Plus and the Pensions Service, that I couldn't claim IB once I reached 60 years of age.

Hi Pat,

I seem to recall from somewhere that if one is receiving the Short Term IB rate and this is worth more than ones State Pension (based on ones Contribution record) then one can continue to receive the Short Term IB rate for upto 1 year after one becomes eligible for State Pension. After this 1 year, the person will be transferred to state pension.

Also, I know that if a War Pensioner receives Unemployability Supplement (the War Pension equivalent of Incapacity benefit) and the Unemployability Supplement is again worth more than State Pension, they can remain on Unemployability Supplement indefinately rather than claim state pension.

These are the only cases I am aware of otherwise as you have said, once you reach pensionable age you are transferred to state pension.

Where will I stand? I receive War Pension Unemployability instead of ICB, except that I also receive £28 per week additional pension when it was paid with the old IVB. Will I lose my £28 per week when I reach 60 or 65?

Hi,

From the War Pension side, you can stay on Unsupp if that works out better for you than state pension (for example a WP and any WP allowances are paid tax free) however everycase is different as to whether this is of benefit or not.

I am not going into the office today as i have been working away for the last two weeks, so i will check it out mid next week as I know one of my colleagues has dealt with someone in a similar situation to what you are if that's okay?
