TOPIC: ESA Appeal

ESA Appeal 7 years 2 weeks ago #12891

  • Allison
Hello can anyone advise please. On the 9th Nov awarded ESA and put into the work related activity group, which im appealing against to be placed in the support group. I have written and requested information on my claim to be sent (the decision makers score sheet, as well as the medical report from the assesment.
I have read the appeal guide on this site, and know I have to get the appeal form filled in, but as I havent got any infomation on why they put me into the wrag, im just wondering should I wait until I have the information as to why? Im just looking at the time I have left until, to lodge an appeal, and incase they dont send out the information I need in time.

Any advise would be helpful,

Thanks !!

When you complete the GL24 appeal form there is no need to go into any detail at this time, because as you have said, you don't know why you have been placed into the WRAG.

All you need to say is something along the lines of "Following my ESA work capability assessment I have been placed in the work-related activity group, and I believe that I should have been placed in the support group because..........". (Give a brief explanation)

On receipt of the GL24 the DWP may offer you an explanation of their decision, and/or may send your casepapers to appeal. When you receive the ESA decision maker's appeal submission, it will give the full reasons why you were placed in the WRAG. At this juncture, you can challenge the decision in more detail as to why you think that you should have been placed in the support group.

Hi Allison,

Being ever cautious I just wanted to add, as I'm sure you are aware having read the guide, that when you challenge a decision it is possible for it to be changed for the worse as well as the better. So when you appeal against a decision to put you in the WRAG it is possible for a decision maker to conclude that you are not eligible for ESA at all.

It's highly unlikely to happen, especially if there is a medical report which supports your being in the WRAG, but it's important to be aware of it.

Good luck,

Steve
