I have just received my DLA tribunal papers through and they are littered with mistakes.

The first glaring one is that they quote they are using the Incapacity Benefit medical and the information on form IB85 - infact it was a Work Capacity Assessment medical and I have never filled in IB85 - it was ESA50!

The thing is if I point these mistakes out politely to the tribunal will they think I am nitpicking?

They are infact saying they have based their decision on a form that doesn't exist!

Hi Nicola,

Yes, do point them out but don't labour them. They suggest that the decision maker was simply going through the motions using standard responses rather than genuinely considering the evidence.
