TOPIC: DLA Change of circumstances and result

DLA Change of circumstances and result 7 years 2 weeks ago #13029

I was on higher rate mobility and lower rate care ,they changed the care component 3 yrs ago I appealed and lost.I recently sent in change of circumstances as have now developed heart problems,Their reply was that my rates would remain the same ,but now they have been awarded indefinately .Should I still try and appeal for the higher rate care ?would they take away the indefinate if I did ?They said that I couldnt have the higher care as I "couldnt cook a meal for myself " this sound the most stupid reason,it was the same the last time ,I really dont understand the reasoning behind this decision !

I thought the above was one of the reasons you actually got the higher care rate?

The cooking test relates to lower rate care.

Hi Sue,

It's a rotten position to be put in. But yes, if you appeal then the whole decision is looked at anew and both rates and length of awards can be changed.

The cooking test is indeed lower rate care
