If you lose you IB, I assume you mean as the result of a failed PCA, then the normal procedure is to submit an appeal if you think that the decision is wrong?

In these circumstances, you would claim either reduced rate IS or JSA if the conditions of entitlement are met, pending the outcome of the appeal.

advice needed esa 7 years 5 days ago #13248

Hope the forum can help. Has anyone succesfully claimed contribution based esa after failing with there IB appeal or during their appeal. I'm sure I've read that some people have. Also read that some have been told they dont have enough contributions. I'm asking this for a friend who is struggling . They cant claim income based as partner works so if anyone has any experience of this please advise

thank you

Having failed the PCA for my IB claim earlier in the year and then breaking down when I tried to make a claim for JSA I was advised to claim ESA by the Jobcentre Plus staff. They initially told me that I couldn't appeal the IB decision if I claimed ESA. I then had a call from them to say that I could both appeal and claim the new ESA.
I still haven't heard about the appeal and am up for a medical re ESA so I may possibly end up having two appeals in th epipe line.
Hope that this helps.

Hi
I was on IB for two years when they suddenly decided I had failed the medical. After advice from the forum I successfully claimed ESA on a contributions basis whilst I appeal the IB decision. The office had to check the rules but phoned later in the day to say I could apply. So go for it!
