TOPIC: ESA

ESA 6 years 11 months ago #13420

I have been taken off ESA and the form says the information from my questionaire. I didnt receive a questionaire, does this make a difference to my appeal against the decision. I was also told i am not going to get any payments and that my MIP will also stop when i asked about money I was told to apply for crisis loans, when I asked about income support I was told that i wouldnt be able to apply as I cant receive 2 benefits, I am confused.

If I were you I'd contact your local Welfare Benefits office or Citizens Advice, they can advise you about what to do for your appeal and also if there are other benefits you can claim.

Hi Sue,

You definitely do need to get individual advice. Check our Help guide for more on how to find someone:

But you definitely should have had a questionnaire to complete for ESA under normal circumstances. Did you have a medical and, if so, were you asked about why there was no questionnaire?

Steve
i had 2 medicals as when I had the first one with a nurse I stated that I sometimes got pins and needles with my back problem and as this was a neurological problem she couldnt carry on with the medical and I would need to be seen by a doctor which I did the following week and she did mention about the questionaire I just said I had never had one and that was it she asked a lot of questions and had me doing a little bit of bending and lifting my legs which I did but they dont move very well she did say something about another medical but I think that must have been the work based thing
I have had lots of problems getting answers due in part to work not sending me the forms at the right time so I didnt get my MIP form on time so they ended up owing me 20 weeks but they took most of the arrears to pay back the over payment of ESA and they seem to have swapped me between contribution based and income based as it suits them
thanks for the advice I will sort something out on Monday
