Have CFS, fibromyalgia, arthritis and agrophobia due to CFS. Had ESA letter today said scored 0 points at medical ESA stopped, my only income! Requested appeal form today but worried that with xmas that they may not get it back in time. Really struggled to attend medical took me three days to recover. Has anyone got any suggestions to help my appeal, what and who should I contact? Stress having really negative impact on my health.

If you download the Employment and Support Allowance Appeals guide from the Members Section and go to page 5 you will see the following:-

Not awarded ESA at all
If you have not been awarded ESA at all, then you have two choices:

1. Claim JSA whilst you appeal. You should be able to restrict the work you are
available for based on your health conditions. In addition, the fact that you have
been claiming JSA should not be used against you in the appeal process.

2. Claim ESA at the assessment phase rate until a decision is made. If you choose to do this you will have to continue submitting sick notes until the matter is finally settled. You will only get the assessment phase rate of ESA, so you will be on a reduced rate if you are under 25 and there will be no additional work-related activity or support component.

If your appeal is successful you will be repaid any amounts that you have missed out on, whether you claimed JSA or ESA.

It may also be advisable to contact your local CAB or Welfare Rights Officer (at your council) to discuss your case to see what further personal advice can be given with respect to what you can claim.
