Hi,

I'm afraid not. When you get a date for your current appeal, the tribunal can only consider that claim, and backdate it to the date you were notified by DWP that your current claim wasn't successful.

Before the regulations changed, tribunals were able to take account of evidence down to the actual date of hearing.

If you decided to make a new claim, it's possible that the Decision Maker (DM) may consider that you satisfied the requirements for an award when you made your first claim, and superceed the original decision. If that happened, then to the best of my knowledge, in those circumstances you would have you claim backdated to the original claim.

However, as I said, I'm not a benefits adviser, so would hope Crazydiamond may be around later, or tomorrow and provide a more definitive answer than I can.
