Hey all

I am just inquiring if any can help with a particluar problem I am having with ESA.

i suffer from MS and was told that I dont have an LCW, I appealed it, it was turned down and when it went to tribunal I was put into the Support due to walking and continence issues. The tribunal was on 10/08/2009 and I have just foubd out that I am to have a medical review in February next year!

I am gathering all the medical evidence I can and I will be sending a copy of the decision by the tribunal with the ESA50 form, the mdical evidence will back up wjy I was awarded the support component.

My question is this does it not seem a bit too soon for me to have a medical review, as the person at the local BDC said that I might mprove and be able to get back to work or be put into the WRA component! Unfortunately I hve M for life so how cna this be the case. Any answers would be gratefully received!

Hi Andy

I'm no expert ... a six month medical review in your situation might well be appropriate as you have MS.

I would if I was in your situation view this as a positive thing. I suspect the Tribunal asked for this when they placed you in the Support Group. They will want to see how you are coping etc..whether you have deteriated in any way because as you know people with MS go through positive and negative patches.

It's a good sign. And I wouldn't worry about it.

It must be very difficult for you adjusting to this life-long illness.

I'm sure other people here with greater knowledge and experience will be able to give you more info.

Hi Andy,

It's worth bearing in mind that the review date for your ESA is based on what the Atos health professional wrote in their report when you had your medical, not on anything that happened at the tribunal.

As it usually takes months between a decision and a tribunal it's very common indeed for people to win their tribunal yet be summoned to another medical within a few months.

It sounds like you're doing all the right things by gathering medical evidence. Make sure you explain in your ESA50 why you still qualify for the support component.
