Belated Happy Birthday Jim.
I think it might be my post that went missing.
I am completely desperate because on Sept 19th I was awarded both mobility and care at high rate, 3 weeks later another letter saying they changed the decision and I was awarded NIL...ZERO. My local WBO said he would help me so we sent off the G24 and then I had a call asking me some fairly non commital questions and then a letter saying I was awarded HRM and HRC until June 2011, my previous award was indefinate but naturally I was not about to argue that.
They paid me some back pay and then on Christmas eve I got yet another letter, this time asking me to say WHY I wanted them to consider an appeal on the award of Sept 19th. Of course I don,t want them to, they already did and then backtracked and then this...I feel so distraught cannot contact WBO and will need to answer their latest letter before he gets back from holiday.What do I do, it says if I am late answering I may lose money, if I do answer they might look again at my award and take it away again. I just do not know what to do.I feel so ill and this has exacerbated my pain and the stress has been horrible, I cannot stop crying , felt too ill to see my family over Christmas and have had to take a lot of extra pain meds. I do not see how I can do the right thing, if I reply I am wrong and if I do not reply I am wrong. Any advise so gratefully needed. Thank you.

In my opinion, I think your case has been handled in an absolutely appalling manner, and this is without doubt one of the worst examples of maladministration I have ever seen. Three different awards ranging from a HRM/HRC indefinite award to nothing, now interspersed with a fixed term award of DLA mobility and care components at the highest rates beggars belief.

In the circumstances, you may wish to pursue a claim for maladministration against the DLA Unit? By taking such an action this will not affect your award of DLA. If you decide to take action on the grounds of maladministration, you may wish to refer to the DWP guidelines which are detailed HERE.

Insofar as the latest correspondence from the DWP regarding your outstanding appeal is concerned, as long as you are satisfied with the "latest" award, simply write to the DLA Unit indicating that you wish to withdraw your appeal with the proviso that the award is allowed to stand without any further interference.

Crazy Diamond,
Thank you for taking time out to reply to my post and for your advice.
The thing is the form about the appeal says I am appealing against their decision letter dated on SEP 19th. That was actually the FIRST letter telling me I had been awarded HRC & HRM.
So if I say I want to withdraw the appeal I am not strictly accurate. It was the letter from Oct that said my claim had been looked at again and now I was awarded, the big NOTHING.
Sorry for the caps but it makes more sense with them, to me anyway struggling with fibro fog, stress over this plus more.
I was told on the phone that everytime they get ANY communication about a claiment they "review" their claim.
So now I am scared to phone or write to them but I know I have to respond.
I am devastated that this has all come up again. I will look now at the link you gave me.
