TOPIC: Incapacity Benefit Tribunal on Tuesday

Incapacity Benefit Tribunal on Tuesday 6 years 10 months ago #14452

  • Darcy
We are appealing my mums withdrawal of incapacity benefit. She was claiming on physical and psychological grounds.

She has Post Traumatic Stress and Chronic pain.

We have 8 specialists in agreement of this. Her private medical reports also state she will never be fit for work.

Do you think we have a good chance of being successful in the tribunal.

We also have a report stating the withdrawal of the benefit caused a relapse in her recovery.

Hi Darcy,

It's really impossible for us to say what the tribunal decision might be without us having access to her tribunal case papers.

However, you can be assured that she'll get a fair hearing, and with so much medical evidence you have in her favour, this should help greatly.

Let us know how she gets on.

Good luck.

I wondered if ptsd would qualify her for incapacity benefit on its own? I can't seem to find anything on the net.

Hi Darcy,

If you look in the Spotlights are of the forum 'Medical Conditions for DLA' you'll see two links, one for the Disability Handbook and the other A-Z of medical conditions.

Whilst these are generally used for DLA claims, they give an insight into the limitations for those with certain medical conditions and should be of help inIB claims also.

It's common practice for the DWP to use information on one benefit to help them assess entitlement to another, especially in IB and DLA claims.

Hope this helps.
