hello all,im new to this site as ive just joined because my 5 year renewal is due at the end of august this year,and i want to be prepaired for the worst.i was expecting to be one of the first 'old school' to be reviewed for esa .however the dwp have moved the date to november now.im now wondering what is likely to happern .would i be lucky and still be reviewed under income support rules for a few more years?.does anybody have any knowledge of what might happen in my case, as its seems to be all up in the air at the moment ,for all of us old incapacity claiments ,and it increases the worry and affecting my health, by not knowing the future.just for the record,im in my 40s and have been on i b for 14 years,and my condition from surgery unfortunately will never improve.many regards everybody, and take care.

Do you mean Income Support rules or Incapacity Benefit? This will make a difference to how we can assist you.

As you are receiving Income Support on the grounds of disability, you will be subject to the same migration progress as Incapacity Benefit claimants.

Although migration starts in October 2010, up until February 2011 there will be a selection of test cases to evaluate how well the migration process is progressing. The bulk of the transfer will take place after February 2011.

As your review period is due in August, the DWP may decide to assess you under the old rules by way of the PCA, or alternatively they may choose to extend the review date and assess you post-February 2011 under the ESA work capability assessment.

Unfortunately there is no way of telling what will happen, as the DWP themselves are probably unaware at this stage how the migration process will proceed? Initially it had been decided that the under 25s claiming IB/IS on the grounds of disability would be migrated first, but whether this is still the case is anybody's guess?

thanks for the reply,its seems that 3 things could happen in my case. 1.- in march - 6mths to review , i recieve an old ib 50 and then reviewed in august under old rules.then givern the next review for esa 1-2-3 years from then.(best outcome at this time).or -2 -recieve a letter in august saying that my review will be posponed until after feb 2011 ie esa in which case i would be sent a esa 50 form at that time allowing 6 mths to go to new medical for esa.or -3 -recieve a letter in august stateing an extension to my current claim and and a new test date a further 1- 2 years ahead for esa.i think that a crystal ball might be handy at this time.anyway im still going to collect my medical porfolio of my rare symptoms and evidence from my consultant, and also make my long time very sympatetic gp aware that im soon to be revewed ,giving both of them an up to date statement of my current condition, ready for them to help me when its needed.i want to be prepaired.
