hi again, just downloaded and have printed off the subject access request form ,there a tick box for computer records , and another box for Clerical records ,

Is this all i need ,,as there is a line at the bottem that says ,,( Any any other personal information , please be as specific as possible )

Letitia, keep going,its getting good, you are already exposing chinks in their armour. Finding ommisions and faults in the medical report will discredit it and make it lose it's value as evidence..The slipshod way it was made without your name etc and now the conflicting evidence that is being exposed is great..keep at it.. Austins advice is brilliant, keep on digging ..keep us updated Letitia .. Regards ..AdamAnt

hi all ,have received letter back from medical services and DLA , regarding the EMP report ,
? Why my name and nino was not on any page not even on the first page ,

? And i had ask for the full list of more difficult movements the EMP stated i was able to do in the previous letter from medical services ,

This is the answer from medical services exactly as written in regards to the name and nino question ,

MEDICAL SERVICES ANSWER

( As the report form which the doctor completes comes in booklet form name and national insurance number is not written on each page )

They did not state wether it had to be on the front page ,they havnt even acknowledged this part of the question ,

Dr ******* does note that on formal examination your movements were "laboured".This indicated that you seemingly witha a lot of difficulty however she goes on to state this contrasted with smooth movements observed informly .
These comments appear to relate to movements of the upper limb ,right leg and neck .


Again no clarication of what i was supposed to have done and again no list of the details i requested ,

I also ask for the full EMP statement at the investagation this also hasnt been supplied

This is the answer from DLA Agency regarding no name or nino on EMP Report

DLA REPLY TO MY COMPLAINT

Your have queried how the discision maker bknew that the report of the Examining Medical Practioner (EMP) was relating to you when each page was not individually referenced .I can confirm that Departmental procedures require the report which is to be completed in respect of a customer to be sent to the EMP as a stabled booklet which is placed in an individual wallet and forwarded ,together with a return envelope ,as a single item to the revelant doctor ,Once completed,the doctor replaces the this booklet in the wallet and returns it in the envelope provided,The report is checked upon receipt for its completeness before it is passed to the decision maker for consideration .


Again no mention of my name or nino been required on the first page ,

Is this legally acceptable ,or should my name and nino been somewhere on this EMP report ,
I need to be 100% certain as i want to bring it up at my appeal .
