appeal or not ? was created by mr lifestyle
I have recently been notified that I have not scored enough points at my Pers Capability Assessment (surprise, surprise) !! 7 out of 10 on Mental Health, but i scored points for things I thought I wouldnt get, and none for things I should have got ? My query being !! I am a Voluntary Carer for my 2 parents, I was getting Incap Benefit and nothing else. Do I appeal and go through hassle and stress, or just apply for Carers Allowance and be about £40 a week worse off ? Any suggestions would be grateful. Thanks

If you believe that the decision to terminate your IB entitlement is wrong, the normal course of action would be to appeal the adverse decision.

As with any appeal there is always going to be an amount of stress and possibly hassle, but you will need to weigh this up against the fact that you will be considerably worse off financially if you decide to claim Carers' Allowance. It would be entirely up to you as to which course of action you choose, but if you do decide to appeal there are guides in the incapacity resources section, which can assist with an appeal.

Please be aware of the time limit if you do decide to appeal, which is one month from the date on the IB disallowance decision letter.

Nothing on this board constitutes legal advice - always consult a professional about specific problems
