Overpayment of IB was created by Janice
Does anyone know what the allowance level is for living expenses when repaying an overpayment of IB, as if there are certain allowable expenses I would like to know what they are so I can claim the right amount - thanks very much

Unlike means tested benefits such as Income Support, there is no maximum amount that the DWP can recover in relation to IB, which is a non-means tested benefit.

The DWP would normally expect to recover up to a third of any remaining non-means tested benefits that are still payable to you. If you no longer receive any social security benefits, the DWP will normally write to you to establish an amount that can be recovered from any monies you receive, such as income from employment.

At this point in time, you can negotiate with the DWP a repayment amount which is affordable, taking into account your normal everyday living expenses. There is no legislation to say what the amount repayable should be, as it very much depends on an individual's circumstances, taking into account all their incoming and outgoing finances.

Thank you very much for your help. I am wondering whether they have a list, for instance, £30 per week for food , etc so I know I am not overclaiming living money according to their regulations, but can safely claim up to the maximum, thanks

The DWP will be able to advise you in connection with this matter.
