Hi Tilly

In my area (Norwich) the CAB won't represent you at hearings for the reasons Steve has given, but there is a charity that does provide a full representation service (Disability Rights Norfolk).

It's worth contacting an advice centre to see if you can find something similar in your area.

Hi Jeff,
I have double incontinence (urinary everyday many times) and other is when IBS (had specialist diagnose) is bad or when meds cause, but they gave zero points to this in ESA medical. I have a condition called interstitial cystitis which means I spend some days in loo all day.... and go constantly, but they just seemed to ignore this in my medical for ESA.

I just don't know how to appeal this ESA, when Atos seemed to ignore all my conditons at the first medical......

You may find it helpful to keep a daily diary which would show how many hours in a day & days in a week of how you are affected by your health problems & present it to the tribunal. You may like to give a copy to your GP/specialist & ask them to write a letter in support referring to your diary. I know it's embarassing to have to divulge such personal details but if we don't then the powers that be assume it isn't a problem.

Hi Maggie and everyone, You are not going to believe this.... I called the Helpline this morning to ask about why I am not getting any money while I appeal and why I have not heard anything other than to be sent another ESA50 to complete... they told me that I had won my appeal without a hearing weeks ago, but they have lost my sick notes (and I guess lost other original papers I sent as well). I have to get them more original sick notes from my GP (will ask them today) and then they will pay me and back date it all.... Go good news, but worrying that I heard nothing. I asked will I get a letter saying I had won the appeal... he was not sure. I also asked do I still have to complete the ESA50 again, he said he was not sure, but best to do it.

Hi All

After you have won an Appeal, do you still have to do another ESA50 form for Atos, as I was sent one last week. The man on the Helpline was not sure.

I called helpline this morning to find I had won my appeal and noone had bothered to notify me... but I was not getting any money as they seem to have lost my original sick notes going back to April..... I told him I have recorded delivery receipt of sending them to them. Alas, I still need to get new copies from GP.

I did my appeal forms before joining here, wish I had joined here first anyway. I thinK I won anyway, as by doing a 3 page summary attached to my appeal forms instead of trying to squeeze in the relevant sections for conditions, medication, procedures, which I did attempt on my previous forms. I did one long list of conditions as the heading, with symptoms of these conditions under each heading (tried to keep to short bullet point format) and anotehr of condtions as headings again, with medications and procedures (with dates and hospitals) under each heading. I am under a lot of specialists and do have quite a number of conditions, meds, procedures(ops) recently - so it ran to 3 pages. Hope that may help someone anyway - as trying to squash into boxes would have made me miss things out.

Yes i do get DLA, it was originally middle rate care but on last review a month ago they have increased it to higher rate care. I did provide a lot of additional information along with medical reports and was extremly surprised when they increased it.
