Hello everyone
I wonder if you could help me please?
I applied for DLa in June 2006. The case went to tribunal and I was refused. We asked for reasons and found that the decision had been taken on part of the bundle not sent to us. Therefore I have been given leave to appeal to the upper tribunal. I have been told by a person at the tribuanl service that it is unusual for things to take this long. Whatever, tha outcome this has caused me great stress. As we have just found out that there has been yet another mistake made, I was thinking that perhaps there may be a case for compensation? Mainly because I am having to chase to correct errors made in the process.

Hi e It does seem unreasonable for your second appeal to take so long. I applied in 2008 and am only just going to tribunal the DLA tribunal service has cancelled twice to date in my case the decision maker made the decision that I could manage cooking etc with strong painkillers and physiotherapy. Hmm Physio's have now sent two letters to my GP to say that as my condition has lasted over 16 years there is nothing they can do. So on that basis Welfare Rights believe I have a case. Perhaps you can ask the Disability Rights commission their opinion? Good luck lisa

I am unaware as to when your case was referred to the Upper Tribunal, but it is not unknown for decisions by a UT Judge to take up to eighteen months.

thnak you very much for your help, I will look at the guide. I have never before considered a compensation claim for anything so this is completely new territory for me.
