I have been on low rate mobility for a few years now as I suffer from severe anxiety attacks. I applied for the higher rate of dla last December as I now have Fybromyalgia as well, and in May I was awarded the middle rate care component and low rate mobility. I then asked for a review so as to get the higher rate mobility as I depend on friends and family taking me for hospital appointments etc by car. I have now lost the middle care component and severe disability premium and am now back to low rate mobility. I have asked for an appeal and now have been told it will take about 20 weeks. Could anyone tell me why you are awarded dla and then lose it after you ask for a review. Its very upsetting.

Hi,

We do warn members in the guides in the 'members only' area, that asking for a review of a current DLA award does sometimes lead to a reduction in their award.

DLA Appeal Tribunals used to be heard within about 6-8 weeks, but the large number of appeals for ESA has created a massive back log.

You may be able to get a quicker hearing, if you are able to accept a date at short notice. Often DLA appellants say they can't attend for all kinds of reasons, and rather than the allocated slot be wasted, the Clerk to the Tribunal will ring around to see if an appellant can attend.

The Tribunals Service will pay for a taxi to get you to the venue on time.
