esa appeal but condition getting worse!

Hi I have contacted the DWP about getting worse, they said as i have appealed, just to get the evidence ( any letters etc)and send it to them or the appeal board and it will all be heard at appeal! thats it! thats your chance!. at the moment 6 months wait for appeal board .as they only send out say 12 slots per month for these appeals and they back up! best wishes, Rap.

Hi Rappa, you need to consult your GP and document how your condition is worsening. If you ned any more medication, tests etc, get the evidence ( copy of prescrition, test forms etc, preferably test results) and send it off to appeals board. You should be getting ESA at assessment rate, so shouldn't be on no money at all. If you win the appeal you will get the extra money reimbursed. I believe, ( not sure though) that appeals are taking up to a year in some areas.

Hi rappa

I take it this is a continuation from another thread with the same name.

The appeal tribunal will only consider you health at the time of the decision to refuse ESA, and will not take into consideration any deterioration in health since. I think the advice Crazydiamond gave you about getting a letter from your GP was with regards to your reclaim of ESA, as you need evidence of a new illness or deterioration in health to reclaim within 6 months of an adverse decision.

yes Derek you are correct, I just happened to get frustrated after a year!and took a job for 2 days but failed with my back etc but got back on esa with "rapid reclaim" just a phone call and payments reinstated! as you say health getting worse not considered , have to go to appeal with evidence, thanks for info. rap
