Excuse me for posting the reply on a new thread - but i have tried to post several replies and they have disappeared into cyberspace.

Thank you for your answer Jim regarding my DLA/Simultaneous claim post.

I totally agree with your comments regarding different DM's and their inconsistancy with awards.

This is evident because we sent two identical (bar names etc) claims for adult siblings, same condition, same drugs, same needs and problems, even the same gp and specialist letters.

Both posted the same day - both went to different DM's - one was awarded indefinate HRM and HRC - the other was awarded nothing.

Hence my question on whether we can submit a new claim form running in tandem with the appeal.

Spookily - The appeal paperwork has just arrived this morning and said it would be atleast March 2011 before we could be heard.

I therefore think we will send the claim in again.

Is it unethical or risky to mark it for the attention of the DM that made the other award (as he seemed to understand and read the claim form) ?

And is there any risk whatsoever to the claim that was awarded by doing this ?

Hi Pawprint,

I don't know whether there would be any risks attached to addressing a claim form to a specific decision maker, but unfortunately I suspect it is extremely unlikely that the DWP would let the customer decide which DM dealt with the form.
