If my appeal for ESA fails, I dont intend to take it to upper tribunal, I just couln't cope with it. In which case I will have to sign on for JSA, but in reality I'm not able to work despite ATOS saying I am. What would happen if my GP continues to give me sick notes and when I go to sign on I produce it and sign something like " my Dr says I am not fit for work". Also, I would only get contribution based JSA for 6 months, so could I then claim ESA again, or would I have to have a different "illness".

If your appeal fails, your GP will be told not to issue you any further sick notes.

You can make a fresh claim for ESA without having any new condition from six months after your original claim was turned down by the decision maker. Appeals are now taking so long that in theory you could stay on ESA forever without ever passing a medical.

Oh, I thought it was 6 months from when they turn you down. So, in effect, if I lose my appeal i can put another claim in and it can be for the same condition I have been turned down for? It seems a strange situation. It would mean that I wouldn't have to sign on for JSA at all then. Have I understood this correctly?

Edit - I was wrong - it's six months from the original decision. This explains it better than I can.
