I have prematurely given up my DLA and IB.

Hello all,

I have recently more or less given up my DLA. I filled in the change of circumstances forms on 20 August 2010 because I had begun to feel an improvement in my health.

On 1st September 2010 I received a letter from the DLA at Blackpool telling me that they were looking again at my claim and that it can take 11 weeks to make a decision and not to contact them unless I have not got a decision before 11 weeks.

I also got a fit note from my G.P. dated 31st August allowing me to do light duties with altered hours for a maximum of 18 per week. I asked for this because I thought my condition had improved to the degree that I could get back and try and do some work.

I then received a £100 job grant from the DWP for signing off IB.

In another letter regarding my IB it states that If I fall sick again on or before 26/10/2010 I can reclaim IB.

I was very premature in my decision making as I have now had a relapse in my condition and I certainly regret filling in the change of circumstances forms and coming off DLA (I have not yet received their decision, but the answers that I put on the form would make it virtually impossible for me to be eligible for it)

I was also premature in thinking that I could return to work and I now regret coming off IB. I know it was a stupid mistake I have made and now that they have got the forms back I realise that I cannot turn back the clock.

Can anyone please advise me as to what I can do now, as I feel so stuck and I could not go through the nightmare that I had to get awarded DLA in the beginning.

Also coming off IB was an unrealistic thing for me to have done so suddenly. I am now very anxious about this situation as I know that the DWP are cutting everything they can, but I feel that I have really put myself in a predicament.

I would be most grateful for any guidance that anyone can give me in regard to the situation that I have stupidly got myself into.

This is a situation which undoubtedly requires face-to-face advice from a welfare rights office/Citizens Advice Bureau.

I responded to your query in another thread regarding your wife's Carers Allowance entitlement, which had resulted in an overpayment.

There are a number of (ongoing) issues involved with both your DLA and IB claims and possibly your wife's CA entitlement, which without access to all the relevant casepapers, would be impossible and indeed unwise to speculate upon in an open forum.

I have this morning spoken on the telephone to the Welfare rights advisor whom represented me at my Tribunal and he told me the reason why the CA dept asked for a repayment from my wife is the way in which she explained to them that she was no longer caring for me. The way she explained it, left the way open for another family member to then be my carer, so the carers'dept then saw fit to close her claim. That is why she no longer receives CA but I am still in receipt of DLA until they process my claim.
