I do permited work-If fit moved onto J.seekers?

I do permitted work on incapacity benefit. Under the new government rules being rolled out in scotland if deemed fit when I am newly assessed by the personal capability assessments would I be allowed to carry on doing permitted work?

Continued... I am not well enough to do any more than 3 hours lower permitted work. So which of the below is most likely to happen to me if I fail my medical-

Am I moved onto jobseekers which does not allow permitted work?

Or may be moved onto income support and allowed to do permitted work with this?

Or moved onto working tax credit being allowed to claim disability element?

I would love to hear peoples views and opinions on this and please ask me to clarify anything I have not made clear if needed. I would require answers assuming I am already able to qualify for any of the above situations depending on how the government work it.

If you are on IB, when you are reassessed, you will be transferred to either ESA or JSA, but not IS unless you are a lone parent.

Before you do any work when you are transferred, I recommend that you read the guidance on working whilst on benefits in the claimants' section of this site and take advice on your individual position from a welfare adviser. www.benefitsandwork.co.uk/help-for-claimants/work

To get working tax credit, you'd need to work at least 16 hours a week (if disabled) or otherwise 30 hours a week. www.direct.gov.uk/en/MoneyTaxAndBenefits...oqualifies/index.htm

If I fail a medical does this mean that I would be transfered to JSA that I would not be allowed to continue on a permitted work basis. Will they pay me no benefit at all if I am working the current 3 working hours(which had been 'permitted' under IB) because of the failed medical.

Am I suddenly forced to work 16 hours when I am not able and claim working tax credit to still receive some extra money. Or does ESA allow for people with a failed medical(On reading it appears that its a physical support benefit replacing IB to all accounts). It appears I'd have to stop my current 3 hours and find a higher paid job or use working tax credit and work 16 hours a week. If I can only manage 3 hours work but Physical assessments say I could do more but I don't see it that way can income support still be claimed after all on the basis of my injury being bad enough?

We don't advise on JSA here, so you will need to get advice and detailed information on this elsewhere.

However, it appears to be possible to do some work whilst on JSA provided that you are still available for work at very short notice. Any money you earn for it may affect your benefits. Therefore if you are transferred to JSA and want to keep doing a few hours work, it will be worth your while to get advice on your position to see whether you will be permitted to do so.

"Around one in ten respondents were undertaking part-time work whilst claiming. A similar number were undertaking voluntary work and/or a course of study whilst claiming. Since the introduction of JSA, more jobseekers were aware that undertaking part-time work whilst claiming was permitted."
