ib medical, ib50 not filled in

ib medical, ib50 not filled in was created by incap99
i was sent a ib50 but refused to fill it in (few month ago)

i have now been called in for a ib medical, can they do this without having a completed ib50?

Hi,

Assuming IB is currently in payment, then yes, they can request you have a medical without an IB50. If you refuse to attend the medical without good cause, then your benefit could be stopped as the Decision Makers would have no evidence on which to award you the continued benefit.

You would then be in the position of having to appeal and to have a tribunal in order to try to regain benefit.

Inicdentally why have you refused to complete the IB50?

hi pete

i refused to fill it in, because my ib was stopped 2 years ago due to the medical report (this has happened many times in the past and always won at appeal)

however at the last appeal the tribunral found me exempt from the pca.

Thanks for getting back.

Have you followed Steves advice on the 'EXEMPT BUT SENT A QUESTIONAIRE' page from this link:

As that explains the procedure and has the letter to send to the DWPz.

yes going down that route with letters etc ready for monday.

i just wernt sure on having to go for medical without the ib50, but thanks for letting me know
