despite a tribunral finding me exempt from the pca a few years ago, no ib113 has been sent to my doctor, and im due to have another ib medical next week.

this will rsult in yet another formal complaint about my doctor not been sent this for, despite me having server mental health [problems including chronic depression.

i have just been to see my doctor who has wrote a note swtating that i will be unable to attend the mediacal, and that my condition has not changed since the last medical.

the dwp has treat my with neglet for a number of years which has had a negative effect on my mental health.

Since October 2008, and the introduction of ESA with Atos taking over responsibility for both the work capability assessment for ESA and the personal capability assessment for IB, the procedure for the issue of form IB113 has changed.

Prior to October 2008, the IB113 was issued to to a claimant's GP at the commencement of the PCA. However, after this date the procedure changed. An IB113 is now issued following the return of form IB50 only if it is considered necessary based upon the answers on the form. The reason for the change was to bring the existing PCA procedure into line with the WCA for ESA. The problem was that the only authority to know of this change was Atos.

There are no hard and fast rules about if and when an IB113 should be issued in any given situation, and it would appear to be an entirely discretionary decision.

I totally agree, but Atos are allowed to be a law unto themselves!

This is a very big issue - there are a lot of people out there including myself who have been exempt from the PCA in the past and cannot understand why their doctor has not been sent a IB113 (sufficient in the past to confirm exemption without the need for an IB50 to be issued or a person being called for a medical).

I think the level of anxiety being caused by this change in the rules administered by 'law unto themselves' Atos is totally unacceptable.

There have been a lot of posts on this issue in previous months and linked to concerns about the IB reassessment process.

If you have a doctor who is supportive then why not ask the DWP/ATOS to send the IB113 before you even complete and return the IB50 Ask in writing and keep a copy . and ask the GP to provide a copy of the IB113 to you.

The IB113 will at least be one item of medical evidence and you will have seen it before any medical examination takes place, if it should be arranged.
