lost triburnal what next was created by johnjjk
hi all went to triburnal today lost was filmed walking unaided anyway dr went with the dwp lost they wanted to give a caution and five yrs on my record / but my solictor said i should appeal well lost today will they still give the caution and pay back 2300 pounds or will go to crown court
ask solictor he does not know

I don't think that's something we can advise you on because we can't second-guess what the DWP will do in your individual case. I think that the only way that you can find out what the DWP is going to do next, i.e. cautioning or prosecuting, is for you or your solicitor to ask them.

For a start a caution can only be given if you admit the 'offence' They cannot 'impose' a caution but subject to the guidance about prosecutions they can prosecute

There are strict rules that apply to giving cautions and administrative penalties (thats what it is called when you accept to pay up instead of being prosecuted) and you need advice about that from a solicitor or appropriately experienced advisor

In any event it isnt neccesarily a case for Crown Court. It depends on the charge and lots of other factors.

sorry, I forgot to add that cautions also require your consent. You have to accept the caution for one to be given as well as admit the offence, and the evidence has to be up to prosecuting level standard. It isn't supposed to be a soft option for 'weak ' cases

i did not accept caution as i was advised by my gp and solictor to appeal now lost that will they offer a caution or do you think they will trow the book at me

Hi,

I am sorry but that question cannot be answered on the forum.

To my knowledge we do not have any solicitors who give advice on the forum, so the only way to get the help you need is face to face from a solicitor/adviser, who can go through all your case notes etc.

No one should even try to speculate or guess what your outcome maybe.
