Had a medical for incapacity benefit 10 weeks ago. I rang this morning for results and was told I failed the medical in September. The doctor didn't give me enough points. It is with the decision makers since September. No one told me I failed the medical and why have the DM not made a decision yet if I failed. It's very confusing.

It is because they have a a huge backlog of work in many Benefit offices.

In members guides here you can findf out how to proceed next with this as I am presuming you might wish to appeal

You might like to get on with it though as there is a time limit on appeals and
also I recommend engaging the help of a CAB or other advice centre

Okay dont know if I will appeal medical was very upsetting so do I just take it that I failed my medical even though Im still being paid do the dm not change the decision sometimes

Yes sometimes they can change the deicision before you have to go to a tribunal but as XFACTOR has said you will have to lodge an appeal in order for them to do that. They have a reconsideration avenue but i am not that sure that that is something that yeilds much success. Start looking around for a representative, i see you are in Northern Ireland, so you should have a CAB or maybe a disability rights organisation(look on the net or phonebook). The guides here are really helpfull and will give you a lot of help.

They look at decisions again anyway when you appeal and so good grounds set out in writing can help some people get the decision changed, although most still need to go to tribunal
