Armed Forces Pension Scheme 75 was created by bellaboo
I think this could be a question for Pete17971 or anyone that has knowledge of Armed Forces pensions.
Hi everyone,
I am on State Retirement Pension,War Pension and an Armed Forces Pension 75 (Services Invalidity Pension non-taxable)
When I applied for Pension Credit as a low income pensioner, the Pension Service allowed a £10 disregard on my War Pension but no disregard allowed at all on my Armed Forces invalidity pension.Is this correct? I'm sure I read somewhere that there should be a disregard on an Armed Forces invalidity pension.
This could mean the difference between being a poor disabled state pensioner and a slightly better off one.The Pension Service are taking my Army invalidity pension as a private occupational pension thus putting me about £1.50 over the threshold for receiving Pension Credit.
Any help on this would be greatly appreciated.

As moderators, our experience and remit is for sickness and disability related benefits.

Hi,

Sorry for the delayed reply - I knew the answer was somewhere in one of my files - just which one!.

Sadly the disregard in the case of Pension Credit only applies to £10 in the case of War Pensions only -

under: The Social Security (Miscellaneous Amendments) (No. 7) Regulations 2008

Where there was a change last year was to include SIP/SAP was with regard to claims for disregard in Housing and Council Tax Benefits and they can have the £10 disregard there (or even full disregard at the discretion of the relevant council).

The Housing Benefit and Council Tax Benefit (War Pension Disregards) (Amendment) Regulations 2009

In the case of IS/Pension Credit there is sadly only the one £10 disregard for the actual War Pension
