Hello,
I have been on incapcity benifit since 1993 and ive not worked since. I currently receive a private ill health pension from my ex employer. I have never had a medical for incapacity benifit as i seem to score enough pionts, but im up for renewal soon. I also receive higher rate motability and lower rate for care.Im married and have a 2 year old child, my wife earns in excess of £20,000 and my pension is also just over £20,000.
Basically are the new rules/legislation being proposed to include means testing, regards my incapcity benifit and will any savings which i may have be taken into account when deciding the amount given.
I simply find the new proposed rules baffling regards work related group and the support group ESA

A lot of questions, I'll do my best to answer them.
All IB claimants will be transferred to ESA over the next four years, it is expected that this will be done based on their renewal date.
The majority of successful ESA claimants will be put in the Work Related Activity Group (WRAG), while about 6% are put in the Support Group.
Successful ESA claimants will receive either Contribution Based ESA, assuming they have paid sufficient NI in qualifying years, or Income Related if they have not.
Legislation to be introduced in the next couple of months will limit the receipt of ESA(CB) for claimants in the WRAG (not the Support Group), to one year, after this time they will be eligible for ESA(IR).
ESA(IR) is means tested, with restrictions on assets (£16,000), the number of hours that a partner can work (24 hours), and deductions for family income (including your pension and your partners income).
The Understanding ESA document in the Members area, explains more about the process and tests that you will need to comply with when you are transferred.
