good news re tribunal last week was created by sleepystardust
I've today had some good news about the tribunal from last week, thank you for the info on here, although I still had to have someone go through it with me to link it to the papers.

I am wondering what happens now and how soon, I waited about 10 months or so after they said I had not passed the medical.

Just saying thanks for the site and all who post.

sorry. I cant believe it is good news it hasn't quite sunken in yet. Apologies! my post doesnt sound I am all that grateful, does it, it just is that it took so long, 10 months, and I cant get my head around it... but thank you! I have m.e./c.f.s. and am so used to people not believing me and of course nothing is the same one day to next, so its hard to describe how i am as I cope with it by living in the moment.

Congratulations. I recieved a letter today from the DWP in Belfast ( im from Newcastle) saying they have re considered my claim and still class me fit for work. The letter also states that they have forwarded my paperwork to the tribunerals services and to expect some corespondance with them in relation to what will happen next. I feel like giving in, I have a life threatening disease and suffer so much physical pain , i dont know if i could go through a tribuneral with out making my self ill

If you don't think you could face a tribunal in person, you could still have a paper appeal. OK, there'd be papers to prepare, but with the waiting times for appeals now, you'd have time to take it slowly. You'd be able to claim ESA in the meantime, and that would be at the same rate as JSA but without the requirement to look for work.

At least sleep on it and see if you feel more positive in the morning.

You should not read to much in this letter. From what you say, it sounds that the DWP have completed a Reconsideration, a normal part of the Appeal process.

Statistically, very few decisions are overturned by a Reconsideration, wheras 40% of Oral Tribunals result in a positive outcome for the claimant.

We have had some positive Tribunal outcomes this week, perhaps some of those who have been successful would care to comment on what they had to do.
