Could you take someone in with you to this medical and have them take photos of everything you are asked to do ?

Hello, sorry to hear about your recent medical, and results. My Wife went for a medical a few weeks ago, and received the results. The Health Care Professional asked her the questions and in her report put down the opposite of everything my Wife said apart from 3 out of 25 answers. Without doing any sight test, she decided my Wife had 20/20 vision, which isn't true. I have just posted the copies of the report from the DWP to our Solicitor today, and have sent a reply for an oral appeal hearing to the Tribunal Service. My Wife has suffered agoraphobia, depression, anxiety and panic attacks for the last 14 years, and has been claiming Incapacity Benefit. Surely The Health Care Profesional should not be given free rain to falsify documents to enable the Decision Maker to knock points off, and the award a low score, and disallow benefits.

One gets the impression that they're positively encouraged to do all those things by a government so incompetent and corrupt it has to pretend there's nothing wrong with the disabled rather than make proper provision for their well-being. Solicitor, eh? - about time we heard that on here.

Thanks, I will keep you up-to-date with any progress we make. The Solicitor is through Legal Aid, and can only put together our appeal, but cannot be present at our Tribunal. our local CAB have run out of funds, and cannot represent us at appeal either. This leaves me having to attend the appeal possibly on my Wife's behalf. The trouble is I claim Incapacity Benefit for depression arthritis, sciatica and cervical spondylosis, and will be due a medical myself this year. Wish me luck. ;)

Fish. I can only imagine your wife's distress at being told she was no longer entitled to IB after receiving it for 14 years, especially as you are claiming the HCP misrepresented most of her answers to the questions asked.

You mention a solicitor - are you considering some sort of legal action or just involving them in assisting you with her appeal?

I would imagine most people are reluctant to make a complaint against Atos Healthcare before their appeal is heard and desperate to put the nightmare behind them once it is over.

It is about time the GMC, and equivalent for nurses, took an interest in the 'fitness to practice' of some of the HCPs employed by Atos.

Thanks for your support. No, it's not legal action, although I wish we could afford to. We tried our local CAB, but they told us we could not get legal aid (which was incorrect), and also they could not help us as they were losing the funding. We contacted Community Legal Advice, who provided a Legal Aid Solicitor. They can only prepare a case for Appeal, and can not represent us on the day, so we are on our own. It has been suggested if we win the Appeal, a case could be made against the HCP to the GMC and the BMA on some sort of grounds (misconduct, incompetence?) But that's a long way off. People should try every legal means to discredit these charlatans, who are a disgrace to their medical colleagues.
