DLA appeal - convene Panel in my home?

DLA appeal - convene Panel in my home? was created by lochlisa
As some of you may be aware I was refused DLA and asked for it to go to appeal.

I immediately re-applied and was awarded LRM based on being unable to leave the home unaccompanied for support and guidance.

Now my condition has become a lot worse and my GP has put in writing that my symptoms are so severe that they are preventing me from leaving home.

This was written to ATOS as they were demanding I attended a medical.

Now, with regards DLA appeal next month. Will submitting my GP's recent letter be enough to ask for a hearing at my home OR will the fact that I am unable to leave home be detrimental to my claim and I could end up losing LRM or should they take an overall view of things and realise that at one point I was able to leave the home accompanied and may be able to do so again in the future?

I have not been awarded and care component at all.

I appreciate you cannot comment on individual cases etc but can anyone offer any guidance at all?

I thought that if someone can not leave a house they did not award mobility ? thought someone posted about that on here the other week

I was awarded when I could go out with a helper.

My condition, at the moment, is too severe for me to go out. It is expected to improve to allow me to start going out again.

Does this mean I should change of circumstances to DLA until such time as I improve again?

It is indeed true that if a DLA claimant cannot leave the house at all, they cannot "from time to time to benefit from enhanced facilities for locomotion" and therefore no mobility component would be payable at either the higher rate or the lower rate.

I don't know I am not an expert, I just know that more than once on here and on he BBC web site "ouch" this comment has come up, I think there is some ruling on the subject as to why its not paid... you could be right if you cant go out you might have to tell them


you need a nice mod to come along who knows the answer :)

Crazydiamond beat you to it :)

However, 'from time to time I can benefit from enhanced facilities for locomotion' - it will all be down to what is considered 'from time to time' I would imagine.

Oh well, will see what tomorrows phone call throws up.
