HI,

Try not to think along the lines of the damage is already done. The only damage that has been done is that a GP, not as familiar with your case as your own GP completed the factual report for DWP.

Now that you are able to send a more relevant report from your own GP should stand in your favour. Hopefully, they will give this due consideration at the reconsideration stage and you may not have to go the whole way to the tribunal. But even if you do, the tribunal will most definately consider your facts.

I am awaiting an appeal hearing, have been waiting since July 2010, so am in receipt of the assessment phase money, so you see the length of time it is taking. I am so sorry for you and for us all. I have been tempted to cancel appeal, but we must fight on. I have 20 months until my State pension , please dont give up, get an appeal in and the assesment money will be reinstated. Citizens advice are helping me with my appeal. Hope this helps. :S

I'm so sorry to read of what you're going through but pleased so many people are trying to help you.
I've just had my Industrial Injury Dis Ben taken away and am also appealing. (Limasierra).
With you all the way, we might have a long wait but hopefully we will get justice.

These decisions are fraudulent and a slur on our names.

Hello again,

Just thought I'd let you know I've received notification from DWP that they have reconsidered my case and awarded me Higher rate mobility andLowest rate care, both indefinite!

Just to update you that following my original decision, I found that a doctor at my practice who has never seen me, submitted a totally misleading report. That was why DWP made the decision they did. Although angry at DWP in the beginning I now understand it wasn't their fault and they were only going on the report of an incompetent GP. (Having said that one would have thought that if there was confusion between my application form and the GP they should have queried this or asked for an independent medical?).

I obtained an accurate report from my own GP as well as reports from two consultants involved in my care (I suffer from arthritis and angina) and sent those away with a lengthy letter emphasising my problems, using B&W guidelines. As I say have just opened my letter to say I'm keeping hiher rate mobility and will get lowest rate care, both indefinitely. They only took 10 days to make the decision and tell me. I can now keep my car which is such a relief.

I am disappointed by the care decision - I was on highest rate care and feel I submitted more than enough to keep that. It is really frustrating to read on your letter statements about what they say you can do or don't need when you know that's simply not true and you feel like screaming out. However, I am minded just to accept as I cannot now risk losing what I have - I.e. Higher rate mobility and therefore access to a modified car.

When on the subject of cars, I must say a word for Motability. They are so nice and helpful when you call and reassured me that they would support me and allow me to keep my car through the appeal. I cannot express how much that meant to me when I was in the depths of despair after getting the original DWP letter.

Thank you to all who replied to my post. This is a wonderful site with so much available resource and worth every single penny of the subscription.

All in all I feel so relieved, notwithstanding the care part of the result. I feel aggrieved about that but my main concern was being able to keep my car and thus my independence and ability to get around so it the current climate I think I am fortunate. Would be interested to hear from any of you on the subject of appealing the care part - should I just accept and be thankful? What are the chances of a tribunal taking the lot?
