can any one tell me how long thsy have had to wait for the tribunal to tell them if about they case ? by this Tuesday 15/03/2011 we have been waiting 68 weeks for the DLA & Tribunal services to make up there mind if we can be award from lower rate to middle rate ?
If we can get middle rate this then will help me to apply for carer's so then I can look after her full time, has any one else waited this long ?

If you are waiting for a Tribunal hearing then 68 week is on the high side, but we have a few members who have waited longer.
If you are waiting for the decision from a Tribunal, then you should have heard within 8 weeks at the most.
In either case, I would suggest you contact the Tribunal Service to find out what is going on.

thanks for reply, my wife has has a lot of problems one is Agoraphobia. in june 2010 her case ( paper hearing )was seat back for a medical Assessment, then in September 2010 2nd aptempt there wanted my wife to attend a oral hearing for the third aptempt.
I did contact the clerk at he tribunal services last week & was told that Paper hearings do not have set dates there get address if ther is a canceal oral hearing we was never adivce this could happene.

Given that you have had 2 adjournments, 68 weeks is probably not unreasonable, however, I am confused as to whether you are waiting for an Oral or Paper hearing.
From your post, the last Tribunal appears to have ordered an Oral hearing, but you are discussing a Paper one?
I don't have the figures to hand, but I am sure the success rate for Paper hearing is less than 10%, whereas the equivalent for Oral hearings (DLA) is more than 50%.
Obviously you have to make a decision based on what your wife can handle, but it would appear that the Thribunal Service, believe you would be better served by an Oral hearing.

hi Gordon
We did reply to the courts to stay she could not make it due to her illness plus Chornic pain. I did asked could I attende to get her case & illness address. She has just recovering over yet another Operation & is likey to have more.
She is due to she a counsultant at the GWH on tuesday 15/03/2011 to see if she is fit to have a nother operation.
