I have today received my letter including news of the increase in benifits. Im on Incapcity since pre 1995.

my question is that within the notice, includes details of the pension income rules.

It list all the types of pensions everyone should notify the dwp of but goes on to say that these rules do not apply if any customer is receiving the DLA allowance care component at the highest level,(im not, only low level) or your incapcity beneifit started before 6th April 2001 you do not need to advise DWP if that is also the case.
I get an ill heath pension provided by my ex employers since 1993 due to my very poor ill health. Incidentally i get regular medicals from Capita Health solutions to make sure im still unfit for work which incidentally my past report stated im unfit fot any type of work at all due to various types of illness i suffer from. Can someone please answer my numerous questions. WOuld bringing my latest copy of the capita ill health medical report do my chances any harm when im called for mt ESA medical?

Many questions sorry but very fruastrated and confussed.

How does that leave me im confussed. I get Incapcity benefit prior to 1995 so do i inform them and more impotantly is this going to be policy for the forthcoming welfare reform?

We expect that those curently receiving Incapacity Benefit will be transferred to Contribution Based ESA.

ESA(CB) has an £85/week disregard for pensions income followed by a deduction of £1 for every £2 of pension income thereafter.

I am not aware of any exemption to notify the DWP of such income for ESA, based on a claimant receiving DLA HRC.

The new Welfare Reform Bill does not modify this aspect of the ESA Regulations, with the exception of limiting the time you can receive ESA(CB) to one year for members of the WRAG (not the Support Group). This bill has not been passed and may be changed before doing so.

Presenting relevant evidence for an ESA review (or indeed any incapacity benefit), should never be a problem, however, your Capita report will focus on why you cannot work, whereas the ESA tests focus on why you can.
