Hi everyone,

I was wondering whether someone could give me some advice about the outcome of my DLA application.

Firstly, can anyone shed any light on why it is recommended that you progress straight to appeal rather than re-consideration? I can't quite see the difference and was hoping someone could explain.

Also, I have been awarded lower rate care indefinitely but am confused as to why, as the aspects which make it difficult for me to cook myself a main meal also make it difficult for me to dress and undress myself and various other aspects included in the claim. They acknowledge that I need help with cooking but say that although I have difficulty with the other aspects I don't need help with them. If I have difficulty with them then surely I need help with them? Does anyone know how I can make it clear that I both have difficulty with these things AND need help?

if you appeal they will carry out review as a matter of course

also the lower rate of care I think covers than just the meal it also covers the need for some help durring the day

middle rate means a lot of care durring the day or night higher rate means lot of care day and night

Hi Pollypots, I was in a very similar situation. I think the only time a reconsideration by itself is likely to work is when you are able to submit extra evidence, such as a doctor or consultant report. I did that and won a partial updating (higher rate mobility) but was left on lower rate care despite having submitting very strong evidence that I needed a great deal more help than just a meal. What really annoyed me was that despite stating specifically,for example, I always need help to get in or out of bed the letter came back saying I didn't need it! It's enough to make you scream! I am still considering a formal appeal to try and get a more appropriate care award but I am so afraid I'll lose my mobility. I suspect they know this and play on those fears.
