Ill cut to the chase

can manage stairs ( true but not without alot of pain which i told her and the pain is not noted on the report)

Can bath unaided but is difficult ( yes its difficult and painful no mention of the pain again)

can dress unaided causes pain dressing lower half

can get in and out of bed unaided ( not without alot of pain!)

although they can manage to dress and get in and out of the bath i feel they would not be able to bend kneel or squat safely without help or regularly stand for more than 30 mins

states in constant pain worse when walking and bearing weight on hip

although client has a long term hip problem and declined for demonstraight movements ( i did not decline she told me if it causes you pain i don't want you to do it) they did walk along the corridor 30 meters at normal pace with no significant signs of discomfort, i feel likely they can walk more that 200 meters without having to stop.

just what exactly am i supposed to do? i suffered from perthes disease as a child now as an adult i suffer constant pain in my hip, i told her i was in constant pain and cant bear any weight on my hip without pain, yet she still says i can walk over 200 meters based on the fact she saw me walk 30 meters down the corridor and because i wasn't yelping out in pain she is assuming i was in no discomfort despite telling her 5 mins earlier that im in constant pain?

What can i do about this report im not happy with it and it give an inaccurate account of my condition.

i have sent it reports from my gp and orthopedic consultant who both state im in pain at all times when walking and my orthopedic consultants report says its likely i will need a hip replacement yet i can still walk over 200 meters?

a disgusting example of the ATOS staff ignoring and making assumptions for the genuinely disabled.

I would lodge an appeal using the CAB at you're first available chance,if you cannot make it to the CAB maybe an advisor could help you over the phone.

Certainly do not let it rest there if you feel badly treated.

sorry to hear you got such an awful report.

my advice is to appeal as soon as possible, so yiur benefit should continue ( theres advice on the site re appeals)

you could also complain about the assessor, not sure if that will get you anywhere, but we should let them know what an awful service they give

You are entitled to make a complaint to ATOS.

From what you have posted, you have medical evidence to support your contention that you are in constant pain, so for the ATOS HCP to have failed to have mentioned it, certainly would be reasonable grounds.

There is an ATOS Complaints Procedures guide in the Other Benefit Info section of the Members area.

With regard to the report and your appeal, discrediting the report is important, but be aware Complaints can take a long time to process, although with appeal times, this may not be a problem.

Sucessfully Complaining about the report should be of considerable assistance with your appeal, however, if the Complaint is rejected, it likely to be a disadvantage.

Ideally you need to speak to an advisor, who can lay out all of the pros and cons for you, so that you can make an informed decision.

I have already submited the GL24 appeal form, before i recived a copy of this report, in their initial decision letter i scored 12 points for not been able to bend or sit.

like i say i explained to her that i was in pain at all times and that i could not bare any weight on my hip without alot of pain, i have no choice but to walk there are no walking aids that remove the need for me to bare weight on my hip.

she has ignored the fact that i told her i could not bare any weight on my hip and that i was in constant pain at all times when walking and decided that as she seen me walk for 30 meters she assumes i could walk a further 170 meters +

i have had this pain in my hip for nearly 10 years now, just because i dont walk around crying or yelping does not mean im not in discomfort. its like you just cant win is does not matter what you tell them, there is nothingn stoping them saying you can walk 5 miles evern if you say you can walk any distance at al. im so angry its just not fair i dont know how they can get away with it and do it to people day in and day out.

how can she assume i can walk over 200 metres based on my telling her im in constant pain, i have a dignosis of perthes disease, she knows im under the care of an othropedic specialst she states i walk with a limp, she wacthed me walk 30 meters and knew that i was in no pain and could go on for 200 meteres? is are theese health care proffesionals phycic or something. im really very angry now

“I told the doctor that I could only walk 20 feet, he has written down that he considers that I can walk 100 metres”. This would constitute a disagreement with a doctor's medical opinion and is an issue appropriate for the DWP Decision Maker and pursued through the reconsideration and appeals process. This would not normally constitute a legitimate cause for complaint, although it could do so if the doctor’s advice is in conflict with the accepted facts or out with the consensus of medical opinion.

what does the last sentence mean? "t could do so if the doctor’s advice is in conflict with the accepted facts or out with the consensus of medical opinion"

is she entitled to just say i can walk 200 meters in her opinion and i cant complain about that.

she states i can get in and out of bed unaided and manage stairs unadid, no where does she mention i have pain doing thoose things and i told her that i did, infact i rember when she got to the getting in and out of bed part, she mutterd quietly to her self "you dont have problems getting in and out of bed do you" and was was about to skip to the next question when i jumped in to say yes i do have problems with that.
