He said he would do his best, however it was clear he was "parroting" the ATOS speel.

I am now going to write to him, very nicely and inform him of Equalities Act regs etc, to put him straight.

Why if your not housebound do you need a home medical ? the GP service which is where the GPs mind set on this matter comes from has guidelines that tell him when and when not to do home visits he is not "parroting" when you spoke with your GP was he doing a home visit ? if he was that would help your case

I think you may be missing the point. I was replying to "not once have I found a case where CAB actually initiate a case for discrimination via country court. There must be a dubious and unsavoury reason for this. "

Referring someone to a solicitor is not initiating a case, it is the client, via the solicitor, that initiates the case.

Then explain why in a 10 year period there were over 50,000 cases of employment discrimination cases but for the same thing for non employment, less than 100 ?

CAB have approx 35,000 outlets in England yet the average non employment discrimination claim is 10 (ten) per year compared to 5,000 per year for employment cases.

Something is seriously wrong with the process.

In my experience advising at the CAB, employment cases were common, but non-employment discrimination cases were very rare. You could go a year or more without ever seeing one.

However, do bear in mind that the two types of discrimination are different in their legal procedures. One takes place in an ET, the other in the county court. There's a difference in people's motivations and financial situations between the two.

People who have lost their job have a big financial motivation to take a case to an ET, not least because if they are seen as being sacked for misconduct, their JSA will be sanctioned. By contrast, non-employment related discrimination may not provide the same incentive.

A county court action can leave a claimant exposed to the risk of costs unless it's in the small claims track, whereas costs are very rarely awarded in the ET.

Therefore, the two types of case are quite different.
