Send copy atos medical as evidence, ESA re-assess?

Hi All,

I have been receiving ESA (Support Group) for about a year, and had an ATOS home medical with a doctor last October. I have recently been sent the new ESA50 to fill in for re-assessment.

I have just received a copy of my medical report. It only has five pages, and on the last page the person who sent it from the Jobcentre has written "Scoring not carried out as placed in the support group", presumably to explain to me why there are no more pages and no score.

What there is of the report is 100% accurate (my health/capabilities are still the same as in October). So my question is: as the medical is both helpful and quite recent, is there any reason why it would be a bad idea to send a copy back to ATOS as supporting evidence with my ESA form?

There is nothing to prevent you from sending a copy of the medical report to Atos with your ESA50, but they may be inclined to disregards the report and conduct another WCA medical assessment on the assumption that your medical condition may have improved with the last six months.

Furthermore, if there was enough evidence to suggest that you should continue to remain in the support group without the need for a medical assessment, this would have been determined by a process called medical scrutiny, which is undertaken by a disability analyst reviewing all the (medical) evidence already held on file.

Following the return of your ESA50 however, depending on the response, Atos may still recommend that you remain in the support group? Unfortunately, it is very difficult to second-guess Atos when conducting the WCA, as they appear to be a law unto themselves!

Hopefully you will remain in the support group!

However, if you are put in the WRAG group and go to appeal, you could use your first report as evidence.

Thanks very much Crazydiamond for the info. In that case I will ask my GP if he can include a comment on prognosis in his letter.
