Backdating DLA

Thank you for all your help on here so far. One further question. Could someone advise on the backdated rulings.... have just had husbands DLA increased but cant have it backdated because we didnt inform within one month.....MY husbands problem started bac IN JUne last year but we thought it was just a temporary slipped disc that was causing him so much pain...and that it would go back in within weeks... we did not get a diagnosis that it was something more long term until a scan result in December , then applied in January. MY husband was also receiving DLA on mental health grounds for phobia and anxiety and not pyhsical, so would this not class as a new claim and not just a change in circumstances. Would any of these be a reason to ask again for it to be backdated or appealing for backdated payments.

If your husband was already in receipt of DLA then it would be a change in circumstance not a new claim.

It cannot be backdated beyond the date you/he informed the DWP of the change.
