The best way to get through it is to be as prepared as you possibly can be by understanding what it entails !

That way, there should be no nasty surprises !

Re: PA4 and SAR

One week after my PIP assessment & am starting to surface. I would like to see the Assessor's Report and from this forum there appears two ways to obtain this: (1) ask for a copy of the PA4 or (2) make a SAR.

My first thoughts are, will either of these provoke DWP to flag me up in some way that I could do without.

I have tried to do a search on this forum because I feel others have similar concerns about "poking the dragon" - but can't find the info.

Are they both dealt with by the same office?

Whether you request personal information verbally or via a written SAR, the request will be dealt with by The DWP Data Control Dept for your area.

They control and store all claimant's personal information whilst also having to comply with all relevant aspects of The Data Protection Act 1998.

An important part of DPA 1998 is them storing your information securely and providing it once you have requested it.

A totally different department deals with PIP Claims/Assessments/Reassessments.

In the 5 years that I have been a Mod many, many, many....................... members have requested personal information such as a PA4 for PIP or ESA85/ESA85A for ESA and I cannot recall one single member telling us that their request instigated a reassessment.

I’ve received the decision on my PIP following my home Assessment. I want to ask for an MR.

I have printed out your “Challenge to a PIP Decision”. The advice on page 8 suggests asking for an MR as soon as you’ve received the decision. But it’s taken me over a week to calm down & take in the “Decision Maker’s Reasoning”.

But, I’ve also read of someone on this site, ringing in asking for an MR and, quick as a flash, before she was able to submit her reasons/extra evidence by letter as to why she felt the decision was wrong, she was sent a letter saying they’ve done the MR and the decision is the same.

Your Feb 2015 Guide to MRs & Appeals seems to say an MR is discussed via telephone. I cannot deal with things on the telephone. With this is mind, I plan to write to them requesting an MR. But I am confused as to whether it would be at this stage that I highlight the areas that I feel they did not fully consider.

On page 2 of your “Appeal Submissions” Guide, (March 2014 version), it seems you are advising to simply formally request an MR and make a general statement asking them to reconsider as I feel the severity of my condition was not fully taken into account.

I have just received my PA4 & from this can see why the Decision Maker came to their decision.

So my question to you is this: Is a request for an MR only a formal administrative process, which allows us to submit further evidence (if we can), before going to Appeal? Rather than fully explaining what I feel the Assessor did not take account of ?
