Do you think I should be relaying this on to DWP ?

To be honest I feel at an impasse as Capita have made it clear they are doing nothing about it.

I think the DWP will have interest in the fact that you have made a complaint to Capita about the assessor but not the details, basically for the reasons above.

You need Capita to complete their complaint procedure, if you are unhappy with their reply then you can escalate the issue to the Independent Case Examiner.

Sorry for turning this into rather a long thread but I assume it helps everyone to know what's going on and how the assessors and DWP handle various things.

This morning we received yet another call from Capita, much the same as yesterday, rather bullish and they are following the argument it's just our word (hubby and my own) against those of the HP so basically they are sticking by her interpretation of events.

She told hubby they were only aware of my complaint letter today which beggars belief and one wonders where on earth it's been for the last two weeks.

Hubby who spoke with them drew their attention to just one of the untruths in the report as an example where the HP wrote I asked for socks as my feet were cold, therefore I was not being honest when I said in my PIP2 that I had no feeling in my feet and left hand and arm. The true scenario was hubby felt my feet, told me they were cold and put socks on for me - as he often does.

He asked for a letter confirming their stance as I gather from speaking with the Independent Case Examiner (thank you for that info Gordon) office that much the same as taking a complaint to an Ombudsman one needs the final letter from the company to be able to do so.

Hubby is utterly incensed, well we both are he subsequently rang DWP and received a call back from a Case Worker. They seemed under the impression Capita had replied to my letter of complaint, when they were made aware this was not the case they seemed unhappy to say the least.

The upshot is that they are suggesting another assessment as they believe the one under question is "unsafe".

From your experience does this happen often and are they likely to use a different assessment provider ? And do they do the new assessment before the MR decision or once that has been made (they said MR's are taking 6 - 8 weeks at the moment.

I'm afraid the Case Worker saying the report is "unsafe" and the DWP requiring a new assessment be carried out are two separate things, you will have to wait and see what happens.

However, if a new assessment is required then the original Decision must also be declared unsafe and at the very least the MR should be put in to abeyance until a new Decision can be made.

I'm afraid Capita has a contract for the area that you live in so whilst I would expect a different assessor to be used, it would be impossible for ATOS to perform the assessment instead.

Thanks for that Gordon.

Just taken a look at your assessment centre links and ATOS seem to overlap with Capita in our part of East Anglia so guess it just might be possible for a change. Will be you posted.

Following on from submitting a "fitness to practice" complaint to the Nursing and Midwifery Council, they have confirmed that they are going to make the matter further and the next step is for the HP to be given the opportunity to respond and explain her actions and reasoning for the less than honest assessment document.

Speaking to the officer he felt not enough people follow this route as it was clear to her that there are far too many HP's acting in an inappropriate manner when carrying out and completing medical assessment forms.

It would be nice to think that a few more HP's could be made to feel a little of the pressure their actions create for us as claimants.
