Yes you can use statements from the report and from your recording, but it is essential that you understand that an award can only be made by you showing that he meets the criteria to score points, undermining the assessment report is important but will not in itself result in that award.

Many thanks, yes we have been very thorough I think in showing how he meets the criteria.

When writing for the tribunal would i also use all of the points i said above? Or are some weaker or not relavant in encouraging the tribunal to ignore assessors recommendations so I should leave them out?

Concentrate on those aspects of the report that are related to his scoring points and try and stick to disputing facts rather than the opinions of the assessor.

For example you say that he said he would recommend an award and then scored him nothing. It wasn't very nice of the assessor to do this but it doesn't contribute to your argument that he should score the points.

I think I've got confused, what is this document below for? What would we use the points mentioned in it for?

"Best Possible Ways to Challenge A PIP Medical Report guide sets out over 50 grounds on which you may be able to appeal against the findings in a PIP medical report."

When you receive the assessment report it will help you go through it to show that it is inaccurate.

Thank you, we have now received the report.

Fortunately the assessor has referenced the tape recording and said he consented to it, so i can easily use the recording as evidence. Sadly some of my sons answers are inaudible.

Unfortunately though, the assessor has still proceded to tell lots of outright lies about what took place during the actual assessment.

Some were in the physical mobility section so the cassette will be of no help there. The assessor's report did not say that my son had to stop some tests due to pain, but this is clear from the tape.

This particular part is relevant to using an aid in the shower. I cant think of any way of disputing what the assessor says (ie normal mobility in neck and spine) except by just saying I dont agree that what he wrote was an accurate reflection of what happened.

I cant prove it though, so what do I do here?
