Thank you, do you mean if I go back to paying my own N.I. Always found that criteria very confusing. When I was on ESA I was a mixture of contribution based and Income Based. Now on Income based JS. Still self employed, but not earning at the mo. Will have to come off JS when 13 weeks run out.

If you haven't been paying for Class 2 NI Contributions then this may effect whether you can claim Contribution Based ESA, however, if you are currently entitled to Income Related JSA then there should not be any problem with you claiming ESA)IR).

I applied for a 'paper' appeal in the end. Have just heard from the Court that they have received it.

Do they give you a date in a similar way to an 'oral' hearing, so that you can send in your written appeal?

You won't be notified of the hearing, your submission and evidence need to be with the DWP not later than four weeks after the date of the letter accompanying the DWP submission that you should shortly receive.

I rang DWP today to change from JSA to ESA again pending Appeal. They have not had the letter from the Court!

Good thing I rang them though, as they (say) they will look into it. As I only have a while before 13 weeks sick is up, it could have ended up with me having nothing at all.

Sometimes it takes a while for the letter to get to the right department.
