It says:

You may be eligible for a Cold Weather Payment for each week of very cold weather in your area if you get Pension Credit or income-related Employment and Support Allowance with a support or work related activity component in the main phase.

I presume this means if he is still on the assessment level, he does not get it?

He is still on the assessment level after 6 months, but that is not his fault. If he is put onto the WR or S level of ESA later, will he get the CWP backdated? It seems unfair that he could be penalised yet again (as many others will be) because the ESA system is not working properly.

Just seen this bit:

You may also be eligible for a Cold Weather Payment for each qualifying week if you are getting Income Support, income-based Jobseeker’s Allowance or income-related Employment and Support Allowance in the assessment phase and have one of the following:

>a pensioner premium, higher pensioner premium or enhanced pensioner premium
>a disability premium, enhanced disability premium or severe disability premium
>a disabled child premium
>Child Tax Credit that includes a disability or severe disability element
>a child who is under five in the family

There is no disability premium with ESA is there? He only gets ESA and DLA, so I presume that means he does not get it.

Due to the delays in assessing people the Government could save themselves a fortune on CWPs!

The moderators have done their best to explain who will, and who will not qualify for Cold Weather Payments, despite the fact that these payments are outside the remit of Benefits and Work.

As Moderators our area of expertise is in relation to disability living allowance, attendance allowance, the personal capability assessment used in connection with incapacity benefits and the work capability assessment used in connection with employment and support allowance. So those are the only subjects on which we can provide reliable information.

However, you need to bear in mind that boards like this can never provide advice to individual claimants about their specific circumstances, for that you need to use an advice agency. All we can offer is general information about how the system works.

I hope this explains which benefits we can, and cannot advise about.
