Hi Bunny,

To be fair, that was not what you asked in your original posting or even the supplementary one.

With regards to the migration from IB to ESA, other than the start date which Yvette Cooper announced (and Steve promulgated in the newsletter) there is as yet no information yet about how it will work 'operationally'.

Until that information is announced, it really is impossible to say how the DWP will 'manage' the migration and whether current IB review dates will or will not be affected.

I am afraid we cannot answer something that no one as yet knows the answer to.

Hi All,

Just to say that, as other moderators have confirmed, we have a date when the government say migration will begin, but that's all we have at present.

We don't know who will be selected first, whether existing review dates will be adhered to or anything else. It's worrying and frustrating for everyone, I know, and it's an issue you may want to raise with your MP as elections loom and they have to start worrying about losing your vote.

The fact that you have an existing DLA award isn't taken into account for ESA and is only taken into account for IB if it relates to exemption. Sadly, it only seems to work the other way around: an ESA report that exaggerates your abilities can be used in relation to deciding - or looking again at - your DLA claim.

The moment we get any further information about transfers to ESA we will let you know. But at present I strongly suspect there is no detailed plan in place.

My reply wasn't meant to be flippant, I was just stating facts. With hind site I could have worded my reply better.

Hi Steve, Pete and Bunny,

Bunny I am sorry but this does not answer your question but regarding migration, I think you will all find that it has started already in some parts of the country. My cousin has been on IB and DLA for about 20 years since a road traffic accident. Her review was due in June 2011. However, after being sent an ESA50 in October 09 which she completed and returned without question, ATOS has now instructed her to attend an EMP on Sunday, 24th January 2010.

According to the DWP the first migration of IB claimants to ESA will not commence until October 2010; this was an announcement made by Yvette Cooper who is the Secretary of State at the DWP.

Based upon this first-hand, reliable information, if indeed your cousin was sent an ESA50 which was in any event well before the IB review date, it would appear that this should not have happened. She may wish to query this discrepancy with her local JCP/BD office. As far as I am aware there are no currents pilots for migration in operation, which would lead to some parts of the country being earmarked for migration earlier than other parts of the country.

In addition to the advice from CD I would also be inclined to contact ones MP and get them to clarify what the situation is with regard to the migration of IB "customers" to ESA telling them that one hs received an ESA50.
