TOPIC: Can I request a medica? (DLA)

Can I request a medica? (DLA) 7 years 10 months ago #14605

I've had my appeal, which I've lost. I never had a medical. Can I request one please? If so, how?

Hi,

Unfortunately you do not have an automatic right to a medical during the claim process or appeal process, and although you can request one on the application form it is upto the DWP Decision Maker whether or not they think a medical is needed in order to reach a decision.

If you havent already, it could be worth asking the tribunal office for the Statement of Reasons from your appeal tribunal and going through that with a welfare rights adviser to see if there has been any error in law made at the appeal. If there hasn't it could be worth claiming again with help from the adviser.

Regards

Pete
